ExperienceYes Courses - Terms of Use

These Terms of Use (“Terms”) govern your access to and participation in ExperienceYes’s online courses delivered through Thinkific (the “Program”). By enrolling in, accessing, or using the Program, you agree to these Terms.
1) Who we are
The Program is provided by ExperienceYes (“ExperienceYes,” “we,” “us,” “our”).
2) Eligibility and account responsibilities
- You must be at least 18 years old to participate.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You agree to provide accurate enrollment information and to keep it updated.
3) License to access the Program
- We grant you a limited, non-exclusive, non-transferable, revocable license to access the Program for your internal, personal professional development.
- Access is provided for the duration stated at purchase or enrollment (for example, a cohort period or a defined access window).
4) Acceptable use
You agree not to:
- Share, sell, sublicense, or transfer your access to any other person.
- Copy, download, record, reproduce, distribute, publicly display, or create derivative works from Program content except as expressly permitted in writing.
- Circumvent security features or attempt to access areas of the platform you are not authorized to access.
- Use the Program in a way that disrupts other participants’ experience.
5) Intellectual property
- All Program materials, including videos, worksheets, assessments, exercises, frameworks, and other content (collectively, “Content”) are owned by ExperienceYes or its licensors and are protected by intellectual property laws.
- BRiQ, Business Relationship IQ, Pressure Patterns, and related course names and materials are proprietary to ExperienceYes.
- No rights are granted to you except as expressly stated in these Terms.
6) Participant conduct and community standards
To keep the Program useful and psychologically safe, you agree to:
- Participate respectfully and professionally.
- Keep discussions constructive.
- Avoid harassment, discrimination, or abusive behavior.
- Maintain confidentiality of other participants’ shared information.
We may remove content you post, suspend access, or remove you from the Program for violations of these standards.
7) Coaching, education, and no professional advice
- The Program is educational and coaching-based.
- If your enrollment includes coaching, you will receive access to up to four (4) coaching sessions of thirty (30) minutes each during a coaching access window of up to twelve (12) weeks from your cohort start date (or other start date communicated in writing).
- Coaching is designed to be used within the standard eight (8) week Program timeline; however, we may allow the coaching access window to extend up to twelve (12) weeks to accommodate scheduling.
- Coaching sessions must be scheduled at times mutually agreed upon by you and the coach, subject to availability.
- Any unused coaching sessions remaining after the coaching access window ends are forfeited and will not be carried forward, refunded, or exchanged.
- If you miss a scheduled coaching session or cancel/reschedule with less than twenty-four (24) hours’ notice, the session will be considered used and will be forfeited.
- Coaching sessions are not therapy, medical care, mental health treatment, legal advice, or financial advice.
- You are responsible for your own decisions, actions, and results.
8) Technology and third-party platforms
- The Program is hosted on Thinkific and may rely on third-party tools (for example, video hosting, conferencing, assessments, or payment processors).
- Your use of those services may be subject to their terms and privacy policies.
- We are not responsible for third-party outages, interruptions, or changes.
9) Payments, refunds, and cancellations
- Pricing, payment terms, and what is included in your enrollment are described at checkout or in your enrollment agreement.
- Unless otherwise stated in writing, all sales are final and fees are non-refundable.
- If a payment plan is offered, you agree to pay all installments on time. Failure to pay may result in suspension of access.
10) Program changes and availability
- We may update, modify, or discontinue parts of the Program to improve quality or reflect changes in content.
- We will make reasonable efforts to provide access as described, though we do not guarantee uninterrupted availability.
11) Confidentiality
- You may receive confidential information about ExperienceYes, the Program, or other participants.
- You agree not to disclose confidential information without permission.
12) Privacy
Our collection and use of personal information is described in our Privacy Policy: learn.experienceyes.com/pages/privacy
13) Disclaimers
- The Program is provided on an “as is” and “as available” basis.
- We make no guarantees regarding specific outcomes, business results, or performance improvements.
- To the maximum extent permitted by law, we disclaim all warranties, express or implied.
14) Limitation of liability
To the maximum extent permitted by law:
- ExperienceYes will not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim related to the Program will not exceed the amount you paid for the Program in the 12 months preceding the event giving rise to the claim.
15) Indemnification
You agree to indemnify and hold harmless ExperienceYes from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Program, violation of these Terms, or infringement of any rights.
16) Termination
- We may suspend or terminate your access if you violate these Terms.
- Upon termination, the license granted to you ends and you must stop using the Content.
17) Governing law and disputes
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
Any dispute will be resolved in state or federal courts located in Colorado, and you consent to jurisdiction and venue in those courts.
18) Updates to these Terms
We may update these Terms from time to time. The updated version will be posted in the Program and will be effective as of the posted effective date.
